摘要
微博侵权行为是一种新类型的侵权行为。目前法律对其没有特殊的规定,在实务中已经出现了一系列新的法律问题。文章对微博侵权责任的归责原则和责任主体进行分析和探讨,并提出根据不同的责任主体和不同的情况适用不用的规则。
Microblogging tort is a new type of tort. There is no special regulation about it. In practice it has brought a series of new legal issues. The article analyses the doctrine of liability fixation and re- sponsible subject of tort liability of microblogging. And it puts forward the point of view that applying dif- ferent rules according to different responsible sub- ject and different situation.
