摘要
随着社会和科技的进步,职务犯罪呈现出智能化趋势,犯罪嫌疑人反侦查能力强、线索证据少、过分依赖口供,是职务犯罪案件侦查中的难题。传统侦查措施已经难以适应当前打击职务犯罪的要求,事实上需要技术侦查措施的介入。2012年刑事诉讼法修正案适应我国目前职务犯罪的特点及侦查工作的需要,赋予了检察机关在办理重大职务犯罪案件时,进行技术侦查的职权。新刑诉法的相关规定不仅给职务犯罪侦查带来了难得的发展机遇,也使职务犯罪侦查面临严峻的挑战。
With the social and technological progress, the job-related crimes are showing intelligent trend. There are problems in investigating job-related crimes, such as suspect＇s strong anti-detection ability, little evidence clues and over-reliance on confessions. Traditional investigative measures have been difficult to adapt to the requirements of the current fights against crimes, in fact, need the intervention of technical investigative measures. The amendment to the Criminal Procedure Law in 2012 adapted to the characteristics of China＇s current crimes and the needs of investigative work, which allowed the prosecution to make technical investigation in the process of handling vital job-related crimes. The relevant provisions of the new Criminal Procedure Law not only bring a rare opportunity for the development of investigation of job-related crimes, but also make the investigation facing severe challenges.
