摘要
体育的特殊性是指在体育的组织和运行中不同于其他社会实践的属性,它决定着体育活动的管理规则有别于其他行业,这些特殊性使体育领域可以豁免欧盟法的适用,尤其是竞争法。随着体育的终身化和产业化,欧盟法开始介入体育的组织和运行并有不断扩大适用的趋势,但仍需要根据个案的具体情况来决定。另外,体育特殊性在法律上的确立对体育法学独立性的构建具有决定性意义。
The specificity of sport refers to its particularities different from other social practices in the organization and running of the sport,this determines the management principle in sport is different from other enterprise.So the field of sport may be exempted from the application of EU law,but with increasing industrialization of the sport and becoming lifelong career for so many athletes,EU law were gradually applied to the organization and operation of sports and will demonstrate an expanding trend in the future though a case by case approach is needed.In addition,the confirmation to the specificity of sport in legal process will determine the independence of the principle of sport law.
