摘要
司法裁判中一般以法律规则为依据,但随着社会生活的不断发展,规则失灵情形不断出现,此时应有法律原则适用之余地。从理论与实证的角度对前述观点进行论证的基础上,指出利益衡量是法律原则适用的中介,在具体操作过程中,利益衡量可细化为三个步骤。
The rule of law is often regarded as the basis of judicial judgment. However, the rapid develop- ment of society leads to the failure of rules, so legal principal is needed at this time. This paper demon- strates this view from both theoretical and practical perspectives, pointing out that interest balancing is the mediation of the appliance of legal principals, and it can be detailed into three steps in operation.
