摘要
中国梦的愿景须依赖现实法治路径加以实现。作为中国梦的法治路径前奏,中国特色社会主义法律体系已经形成。在体系后研究范式下,须重新审视中国司法裁决的基准,而裁决基准的重建是从司法向度上实现中国梦法治路径的关键环节。裁判规范作为重建的裁决基准,是法官从多元结构的法源中识别发现的,结合个案事实与法律条文进行以法律规则为勾勒模型的解释而具体建构出的个别规范。裁判规范以中国场景中的司法问题及解决为现实生活关照,并能与法官法源相兼容,从而可看作实现中国梦法治路径的正当选择。
The realization of Chinese Dream must depend on the path of rule of law.The socialist legal system with Chinese characteristics as the prelude about Chinese Dream’s path of rule of law has been formed.In the study paradigm after the formation of legal system,the benchmark of Chinese j udicial deci-sion should be reviewed.From the perspective of j ustice the reconstruction of ruling benchmark is the key link in realizing Chinese Dream’s path of rule of law.Adj udication norms,as the ruling benchmark of re-construction,are individual forms that are identified and found by j udges from multiple-structure source of laws,and constructed according to the combined interpretation of individual cases and legal provisions.Ad-j udication norms should be based on j udicial problems and solutions in China’s reality and compatible with j udges and sources of laws.Therefore,it can be seen as legitimate choice about realizing the path of rule of law towards Chinese Dream.
