论我国不动产善意取得制度的完善——以遏制夫妻共有房屋被一方擅自处分为视角 被引量:3

摘要 《不动产登记条例》的制定工作已经提到议事日程上来,据此,不动产登记的公示公信问题势必成为社会关注的热点问题,但在很多家庭都将不动产登记在夫妻一方名下的情况下,过于强调不动产登记簿的公信力,会在一定程度上给一些家庭关系带来负面影响,甚至导致家庭中弱势群体的利益难以保障。因此,在不动产登记条例的制定中,应当充分体现婚姻法的精神,注重夫妻财产制与不动产登记制度的衔接,并借此进一步完善不动产善意取得制度,最大限度地保护家庭财产的安全,从源头上遏制夫妻共有房屋被一方擅自处分的问题。 As the enactment of Regulation on the Registration of Real Estate has been put on the agenda,the publicity and public trust of real estate register is bound to become a hot topic of social concerns.However,under the circumstance that in most families the housing is registered under the name of one spouse,an over-emphasis on the public trust of real estate register will,to some extent,bring negative influences on the familial relations,even lead to a lack of security for the interests of the disadvantaged ones in a family.Therefore,in the enactment of Regulation on the Registration of Real Estate,the spirit of marriage law should be fully embodied,while great attention should be paid to link the matrimonial property system with the system of real estate register,so as to further improve the bona fide acquisition system of real estate,to protect the safety of family property at utmost,and to prevent the unauthorized disposition of housing under community property by one spouse from the very source.
