摘要
现行刑事犯罪司法追究过程要求亲亲互证,这与我国自古以来重亲情人伦的社会传统不太吻合。本文认为,刑诉法应借鉴中国古代"亲亲相隐"的法律思想及外国立法中的类似规定,并从"容隐权"的性质、近亲属主体的范围及限制罪种的适用等方面重建"亲亲相隐"的法律制度。
The present process of our criminal judicial investigation requires relatives＇ ＂mutual certification＂, which goes against the deep-rooted tradition to accord the topmost priorities to family bond and human relations. In view of this, this essay proposes that the Criminal t＇rocedure Law should draw on the legal thinking of relatives＇ ＂mutual concealment＂ in ancient China and the similar stipulation in foreign legislation to reconstruct the legal system of relatives＇ ＂mutual concealment＂ by defining the nature of ＂the concealment rights of relatives＂, the scope of the subject of close relatives and the application of restricted crimes, etc.
