摘要
罗尔斯以“无知之幕”的设计框架和天赋资质的社会性规定为基础提出了他的正义原则。但是,他的“无知之幕”的设计是虚幻无力的,他的天赋资质的社会性规定是错误的,其论证过程也存在着严重的逻辑脱节。他的理论前提决定了他的正义理论的非历史主义的和相对主义的缺陷。
Rawls proposes his two principles of justice on the basis of his device of veil of ignorance, which remains hypocritical and of no help to his principle of freedom, and his definition of human assets,which is considered to be social, denying private-individual properties of human assets. Therefore, his logical process from the devices runs into a dilemma that his desired principles cannot derive from them with justification and can only be rescued by a negotiation between his devices and the social situations where he lives. It is crucial to point out that his theories of justice are doomed to be anti - historical and somewhat relative by his device.
