摘要
研究城市化土地征收中保护农民土地用益物权的问题,从保护农民用益物权的角度推动土地征收改革,有助于实现城市建设中土地征收科学化、理性化、和谐化进行。文章以湖北荆州为例,介绍荆州在土地征收中进行的"保护农民土地用益物权"的改革,其典型特点是回应征地群众的"民生诉求",通过给予农民"携土地资源用益物权"入城的市民身份,并创造农民可以"自由择业"的"宜农则农、宜商则商、宜工则工"的经济环境,使得失地群众生活"有依靠"、工作"有奔头",从而有效保护了农民的土地用益物权。
This article does research on the protection of farmers ’ land usufruct of land expropriation in the city. From the perspective of the protection of farmers usufructuary right , it is to promote the reform of Land Expropriation and contribute to the achievement of scientific , rational , harmonious process during the land expropriation of the city construction. This article has taken Jingzhou , Hubei as an example to introduce the ＂ reform of the protection of farmers ’ land usufructuary right ＂ in the process of land acquisition , whose typical feature is to respond to ＂ appeal to people＇s livelihood ＂ of land masses. Through giving the citizenship to farmers ＂ with land resources usufruct＂ into the city , and creating the economic environment that ＂ farmers can choose jobs freely ＂, that is to say ,＂ the jobs suitable for the agriculture , the jobs suitable for business , and the jobs suitable for industry ＂, it has made the people with lost lands have the support of living and the hope of working so as to effectively protect the farmers’land usufruct.
