摘要
随着城市化进程的深入,城中村现象在全国范围内普遍呈现。加快城中村改造是顺应新型城镇化建设、统筹城乡协调发展、实现城乡一体化的必然要求。城中村改造的首要前提是集体土地权利制度创新与土地权利合理配置:即如何在农民集体成员全部自愿转为市民的前提下,实现集体土地国有;在集体土地国有化前提下,赋予集体建设用地与农民宅基地以土地发展权,促进集体建设用地使用权、农民宅基地使用权与国有建设用地使用权同等入市有效流转,并全面处理好小产权房问题。实现地方政府由"保障换土地"的旧思路向"赋权换土地"的新思路创新转化,最终建立政府、村集体及村民、外来人口乃至开发商多方城中村改造参与主体的土地权益均衡分享机制,促进土地权利公平、合理、有效配置,实现城乡一体化并推动城中村改造向着可持续发展的新型城镇化转型。
With the development of urbanization of China,the problems and opportunities of＂villages in city＂（ Vi C） are emerged. Speeding up the regeneration of Vi C is the demand of new urbanization,integration of cities and countryside. The premise of Vi C reaeration involves the regulation innovation of collective land rights and rational configuration of land rights. Namely,the collective lands are turned to be state-owned while the peasants on the collective lands are transferred into citizens according to their own willing; land development rights are permitted for the collective lands and peasants＇ residential bases; the collective lands,peasants＇ residential land and state-owned lands are equally permitted to be exchanged in market; and the limited property houses are legally handled. The old method,taking lands by social security,should be changed to taking lands by land empowerment as a new method for the local governors. In the end,the mechanism of the fair land profit and right allocation is established among the local governors,countryside collectives and peasants,property developers and other participants in the regeneration of Vi C. A new sustainable urbanization and city-and-countryside-integration mode can be established based on the fair,rational and efficient configuration of land rights with the development of ViC.
