摘要
以国家广电总局实施的"限广令"为分析对象,以西方法治国家广播电视政府规制为比较视角,从规制依据、规制目标、规制主体、规制结构、规制手段、规制效果等具体问题入手,探讨政府对广电媒体广告播放行为进行规制的正当性、必要性和实效性,分析规制应遵循的原则和界限,提出在权利保障和行政法治前提下改进中国广播电视规制。
By comparing the regulation of banning commercials on TV with western countries' regulatory way of TV and radio industry, this paper aims to investigate the legitimacy and the necessity and the effectiveness of this kind of government action. It suggests that China~ TV and radio industry should be improved under the premise of pro- tecting the rights and the ruling by law.
