摘要
探讨市场中自然使用的商标,即先后商标皆未注册时的利益安排。所涉制度为《反不正当竞争法》第5条第2项,该制度的适用存在颇多疑点,如"知名"、"特有"认定等。这些问题关涉到我国商标制度的根基:如何对待未注册商标?其显著性是否需要细分?知名度如何认定?以及商标保护范围与知名度的关系。分析美、德两个国家的具体做法,并加以综合,尝试对我国如何在现有体系下合理解决相关纠纷,予以解答。与此同时,也提出对本制度应该模样的基本观点。
It will be discussed in this article how we should deal with the situation in which the senior use and junior use of the same or similar marks are both unregistered, which is provided in the section 5(2) of the Anti-Unfair Competition Law of China, reflecting our strong registration system. The resolution of this issue involves some basic rules in our trademark system, such as, how to regulate unregistered marks, whether to subdivide the distinctiveness, and how to define the famousness or notedness. By making comparison between and studying the trademark systems of U.S. and Germany, China will be quite persuasive for the future revision of our system.
