摘要
中国入世前后,TRIPS 协议受到知识产权学界的特别关注:许多学者都力图从它的条文中寻求"微言大义",以此解决一些争论已久的问题。其中对于第50条"临时措施"条款,许多学者都认为从中可以找到"即发侵权"的理论基础,将其看作是对传统侵权理论在知识产权领域应用的一项突破。本文通过理论及实践两个角度的考察,力求证明不应将"即发侵权"列入"侵权"的范畴之内,防止"即发侵权"的出路在于创设"知识产权请求权","临时措施"实际上是"知识产权请求权"的形式之一。
Before and after China's WTO entry,the TRIPS Agreement draws much attention from the IP community.Many a scholar is seeking'something trivial but fundamental'from its provisions to find solutions to some outstanding problems long under debate.For example,for them, something governing 'imminent infringement' lie behind Article 50 'Provisional Measures',which represents a breakthrough of the application of the conventional infringement theory in the field of intellectual property.Presenting theoretic and practical analyses,this article seeks to confirm that'imminent infringement'should not fall within the category of 'infringement',the way to prevent'imminent infringement'is to put in place the'right of claim for the IP rights',and in effect the'provisional measures'are one of the forms thereof.
