摘要
从徒刑执行实践看,监狱内外对徒刑的理解、尤其是对徒刑中"自由"的内涵认识存在严重困惑,由此导致徒刑实践非常随意、矛盾与尴尬。因此,立足我国徒刑实践,加大对徒刑内涵的科学揭示十分必要与重要。
According to the practice of the imprisonment, there is a serious confusion on the understanding of imprisonment, es- peciaUy the connotation of ＂freedom＂ ei- ther inside or outside the prison, resulting in that the practice of imprisonment is very arbitrary, contradictory and embarrassing. Therefore, it is very necessary and impor- tant to increase the scientific revealment of the connotation of imprisonment based on the practice of China＇s imprisonment.
