摘要
城市群租现象的产生是当前我国区域经济发展不平衡、低收入群体生活保障不全面及相关法律规范不完备的必然产物。作为一种特殊的租赁法律关系,群租具有其存在的合法性基础,对其进行规制应当充分重视私法自治的作用,行政机关的公权力应当在合法的基础上适当谨慎地介入,在规范群租现象的同时充分保障社会弱势群体的权利。
The emerging of Urban Group - Oriented Leasing is the inevitable result of unbalanced regional economic development and life guarantee is not comprehensive in low in- come groups in the present. As a specific jural relation, Group - Oriented Leasing has its basis of validity in existence. This essay points out that it should fully attach importance to privatautonomie while governing it, and on a legitimate basis, the public power of administrative bodies should get involved to an appropriate and prudent extent, protecting disadvantaged groups while standardizing Group- Oriented Leasing.
