摘要
在世界各国的环境刑事特别立法中,澳大利亚新南威尔士州的《环境犯罪与惩治法》极富特色。其所规定的环境犯罪、环境犯罪抗辩事由、环境刑事诉讼程序、环境刑罚辅助措施、影响量刑的事项、刑法控制污染的其他配套措施等内容针对性较强,值得我国借鉴。在生态文明建设中,我国应加大刑事治污力度,借鉴新南威尔士州《环境犯罪与惩治法》的立法经验,制定专门的《环境犯罪惩治法》。
Among environment criminal activity legislations of countries in the world,the Australian New South Wales Environmental Offences and Penalties Act is,in particular,highly characteristic.The provisions of the environmental crime,reasons for environmental crime deraignment,the environment criminal procedure,environmental punishment auxiliary measures,matters effecting sentencing,and other supporting measures of criminal law to control pollution are very good guidelines and can be used as references for our country.In the construction of ecological civilization,our country should increase the effort to prevent pollution by applying criminal laws.We should formulate the special Environmental Offences and Penalties Act based on the legislation experience of the New South Wales Environmental Offences and Penalties Act.
