摘要
法律文化是一种由社会基本矛盾决定的社会意识形态,其对作为社会实践主体的人的意义重大,即法律文化对人具有重要价值。受古代"和为贵"的法律文化思想的影响,我国法律文化历来奉行息事宁人的无讼价值取向,这在很大程度上阻碍了我国社会主义法制化进程。应当吸收和借鉴西方国家的先进立法经验,把公平正义作为当代中国法律文化价值的应然归属,以加快我国社会主义法制化进程,促进公平正义的社会主义法治理念的贯彻和实施。
The legal culture is a social ideology determined by basic social contradictions, which is possessed of important significance towards people as a social practical subjects, that is,the legal culture are of great value to people. Our legal culture has always pursued a conciliatory value orientation because the thought of ＂harmony is the most valuable＂ from ancient China always has an effect on it , which largely hinders the process of Chinese socialist legalization. We should absorb and learn from the advanced legislative experience from western c~＇ountries and consider fairness and justice as the natural attribution of contemporary Chinese legal cutural value in order to accelerate the process of Chinese socialist legalization and promote the implementation and enforcement of the socialist rule of law concept of fairness and justice.
