摘要
我国目前正处在由经济转型而引发的整个社会转型的历史转折点,改革开放30多年带给人民经济福音的同时,也出现了许多前所未有的社会矛盾和社会问题。社会利益纷争日益呈现出多元化的新态势,使得以法治为主的新的多元解纷机制的建构显得极为迫切。本文以西安地区近五年来构建司法、行政、仲裁、调解等多种方式并存的多元解纷机制的实践为对象,在图绘各种解纷方式的现实地位和实际效果的基础上,进行了尝试性的病理分析,进而对转型时期的解纷方式,做出对策性的反思与论证。
China is now standing at the historical turning point of a total society transition kicked off by the economic transition. Coinciding with the economic welfare brought to the grassroots Chinese by the 30 -year Reform and Open - up, there have popped up myriads of social contradictions and social problems. The author points out with the rising of a new situation that the conflicts of social vested interests are getting ever more multi -sided,it becomes utterly urgent to establish a multi -sided -dispute -solving mechanism dominated by law - and - order. This paper is intended on a tentative case study. On the practice of constructing a multi - sided（ to be exact, simultaneously conducting process of jurisdiction, administration, arbitration and media- tion）dispute -solving mechanism in the Xi＇an District in the recent five years. Our case study is basing on a graphic diagramming of the real situation and practical outcome of various modes of dispute -solving, so as to propose countermeasures and reflections on the dispute -solving modes in the transitional period.
