摘要
如果将秩序的应然目标视为秩序与自由的和谐,那么对强调人的社会活动、行为具有一致性、连续性、确定性的秩序观所可能带来的法律负面的担心就绝非多余。以“一致性。确定性”为核心内容的秩序伤害自由与社会,无论从形而上的价值观或功利主义立场都可以得出这一结论。秩序问题不纯粹是个理论问题,也是具有很强实践意义的问题,对此问题的讨论应该放置在相对确定的文化背景下。因此,从抽象意义上或许很难对“集体本位的刚性秩序”和“个人本位的柔性秩序”作优劣比较,然若将其放置于中国乃至东方文化传统中,则“柔性秩序”的建构便具有很强的针对性和法律意义,即强化扩大私权,弱化规范公权,激活自律机制,鼓励私力救济。
We can easily for a conclusion that fm the angle of either metaphysics or utilitarianism, Order, with the essence of consistency and stability, damages freedom and society. Order is pot only a theoretical problem but also a practical one, which should be discussed in a relative Cultural background. It's difficult to compare the collective standard order with the individual standard order. Yet the latter is meaningful to law, especially to Chinese even Oriental law tradition, and is utilized to strengthen the private tight, weaken the public right, activate the self-control system and encourage private relief.
