摘要
食盐专营是典型的特许垄断行业,一直以来被视为反垄断法当然豁免适用的领域。对基于公共利益的行业豁免理论进行反思,对特许垄断行业整体豁免适用反垄断法的历史实践进行考察,动摇了食盐专营整体豁免适用反垄断法的基础。遵循"最小豁免原则"评判食盐专营下的具体垄断行为应是规制食盐专营的普遍态度。
Due to typical chartered monopoly industry, the salt franchise is regarded to be ruled out application of antitrust law. Based on the reconsideration of public interest immunity doctrines and the historical practice of whole exemption of salt monopoly, it is im- proper to prevent the salt franchise from jurisdiction under antitrust laws. Minimum immunity principle is basic way to judge salt fran- chise.
