摘要
如何确保著作权转让的便捷与安全,是我国著作权法第三次修改亟需解决的一个问题。著作权转让与登记制度的型构离不开对我国民法物权理论的借鉴与扬弃,其基点在于对民法物权理论内在机理的领悟及对著作权相较于物权的特殊性的考量。物权登记公示的公信力来源于登记制度的科学构造及其较高的权利表征概率,而著作权登记公示因其较低的权利表征概率而不宜被赋予公信力。物权变动的公示要件主义与不动产的公信力制度及动产的种类物交易、未来物交易及多重买卖的交易实践具有内在逻辑相契性,而著作权转让不存在上述对应制度或实践需求,因而公示要件主义对于著作权转让并不具有内在契合性,公示要件主义对于维护著作权交易安全而言,有杀鸡用牛刀之嫌。著作权登记宜采用公示对抗主义,登记不具有公信力。
How to ensure freedom of copyright transfer and at the same time to protect trade safety is a problem that needs to be solved immediately in this round of copyright law modification. Copyright transfer and registration system construction can not do without borrow and abandon the property right theory. The key point is that we should have an insight over the internal mechanism of property fight system and compare the difference between copyright and tangible property right. Credibility of the registration for tangible property fight results from perfect design for registration system for tangible property fight and its high accuracy for right registration. Lack of high accuracy, copyright registration should not be granted absolute credibility. The Model of Registration as a Requisite, which fits well with tangible property right, due to credibility system for real property and practical needs for category transfer, future goods transfer for chattel property, does not fit with copyright transfer. Copyright transfer should adopt Registration as a Defenee Model, and registration should not have absolute credibility.
