论数据库的邻接权保护被引量：10

摘要数据库的版权保护、特殊权利保护以及反不正当竞争法保护虽然已在一些国家得到采用,但均未能让人们完全接受,其原因就在于错误的将数据库与版权法中的"汇编作品"相类比,作为构建数据库保护制度的基础。事实上,数据库是技术推动下新生的信息传播方式,采用邻接权来保护数据库更为恰当。
