摘要
"恶意欠薪"入罪化弥补了现行刑法的局限性,完善了规范劳资关系的法律体系。"恶意欠薪"入罪后的司法效果及其司法资源是否过度消耗不应作为其立法判断的必要条件。"恶意欠薪"行为主体、犯罪数额及其免责意义有待进一步的思考。"恶意欠薪"入罪化还存在体系性"短板",需进行制度性完善。
The criminalization of "malicious back pay" replenishes the limitation of the present criminal law,and shall better the legal system that regulates labor relations.The aftermath effect and whether the legislation may result in over-consumption of judicial resources should not be a prerequisite for the judicial judgment.Actually,further observations should be given to the behavioral subject,the criminal amount and exemption significance because there are institutional short planks in the criminalization of "malicious back pay",and therefore further perfection is necessary.
