摘要
中国法律传统中有一个显而易见的特点,即法律判决的非终局性。其含义是只要当事人觉得不公平,他总是可以请求统治阶层复审。非终局性是实质正义观的反映,而现代法律制度更注重形式正义和判决的终局性。虽然司法程序的非终局性既是传统中国也是当代中国司法制度的一个特色,但这里主要关注传统中国司法程序的非终局性。从解释中国司法程序中的非终局性概念入手,结合中国的社会框架可以对这一法律现象作详细分析。
This article addresses an obvious feature in Chinese legal tradition, the non-finality of judicial process, which means that as long as a person feels he is wronged after a verdict is given, he can always appeal to authorities for a retrial. The article points out that non-finality is a manifestation of the belief in substantive justice which was characteristic of Gemeinschaft type of justice but obviously has been overshadowed by modern prevalence of procedural justice. Although non-finality is a feature shared by traditional and contemporary Chinese legal systems, this article will only focus on the tradition. The article starts with an explanation of the concept of non-finality, moves on to analyze it from the perspective of social framework in imperial China and concludes with a brief comparison of two types of judge centrism respectively represented by traditional Chinese belief in "blue heaven" type judge and Dworkinian super judge Hercules.
