摘要
强制性规范制度是中国国际私法多元选法体系中的一元。在《涉外民事关系法律适用法》的框架下,强制性规范的适用应以关涉重大公益为必要条件,法院对强制性规范的认定与适用应遵循比例原则。外国准据法所属国的强制性规范不得仅因具有公法性质而被排除适用。尽管现行法未就第三国强制性规范作出规定,但中国法院仍可在实体法框架下考虑此类规范的效力。对重大公益的关照使强制性规范成为当事人意思自治的必要限制。在现有冲突规范的配置格局下,强制性规范、公共秩序与法律规避可以并存。
Mandatory rules are an integral part of the choice-of-law system of China's private international law.Within the framework of the Law of the Application of Law for Foreign-related Civil Relations of the People's Republic of China,the application of mandatory rules should be premised on the involvement of significant public benefits,and the people's courts should ascertain and apply mandatory rules in accordance with the principle of proportionality.The mandatory rules of a country to which foreign law is applicable cannot be excluded from application simply due to its public law nature.Although the existing law has made no specifications on the mandatory rules of the third country,Chinese courts can still consider the efficacy of such rules within the framework of substantive law.The concerns about significant public benefits make it possible for mandatory rules to become a necessary constraint on party autonomy.Under the allocation pattern of existing conflict rules,mandatory rules,public order and legal evasion can coexist.
