摘要
顶岗实习是职业教育十分重要的教学环节,但顶岗实习存在劳动风险。我国应建立学生实习劳动伤害社会保险制度化解学生顶岗实习劳动风险。学生实习劳动伤害社会保险基金应由政府、学校和实习单位按照适当的比例或费率共同来筹集。学生实习劳动伤害社会保险基金赔付范围的学生实习劳动伤害事故应当具备与学校的教育教学行为具有关联性和与实习单位的职业劳动具有关联性两个条件。学生实习劳动伤害社会保险基金的赔付应当以法定的程序进行,赔付的内容应包括治疗费用赔付、伤残赔付和死亡赔付。
Internship has been an important teaching step of vocational education. But labor risk exists in internship. So it is necessary to build a social insurance system of students＇ practice labor injury for the purpose of solving students＇ internship labor risk. The students＇ practice la- bor injury social insurance fund should be collected by government, college and practice company in a due proportion or rate. Accidents in com- pensation range of the students＇ practice labor injury social insurance fund should be in the correlation of the affairs of college teaching and voca- tional labor in practice companies. The compensation is conducted in legal proceedings, including curing cost, disability cost and death cost.
