摘要
听证制度是行政程序法的核心和灵魂,对于规范边防行政执法有着重要意义。公安边防行政执法过程中适用听证制度存在适用范围过窄、法律规定不完善、听证主持人地位不独立、执法人员素质偏低等问题。完善边防执法过程中的听证制度,要从扩大听证适用范围、完善法律法规、健全听证主持人制度、加强执法人员培训力度等方面入手。
The heating system is the core and soul of the administrative procedure law. It is of significance to standardize the border of administrative law enforcement. However, there exist some problems - the heating system of the public security border administration law enforcement process is narrow, the law is imperfect, the status of heating compeers is not independent, the law enforcement personnel quality is not qualified. These problems are to be addressed in terms of expanding the scope of application, of perfecting regulations and laws and regulations and the heating manager system, of strengthening law enforcement personnel training and other aspects concerned.
