摘要
随着"小悦悦事件"的披露,由此引发的法律与道德的讨论在我们的视线中久久难以消褪。因此,厘清社会规范调控体系中的法律与道德的界限,并基于法律与道德调控范围交叉而产生的见危不助规制进行道德反思和法律审视,以此试图借助法律的手段从见危不助的反向切入,即探求对见义勇为者的物质利益进行保障从而达到规制见危不助的目的。
With the exposition of Little Yueyue Event,discussion on law and moral has been more and more,deeper and deeper.Define the limit between laws and moral in social rules regulation system and have moral rethinking and law re-evaluation of non-salvation-in-danger rule resulted from the confliction between law and moral as to study non-salvation-in-danger from the opposite direction by way of law means,that is,protecting material rewards to the righteous behaviours to regulate non-salvation-in-danger.
