摘要
非法证据排除规则作为美国刑事司法制度的核心,对世界产生了重要的影响。任何规则,都有其产生和发展的过程,非法证据排除规则也不例外。我国在构建适合自己的刑事司法制度中,也注重借鉴美国的经验。希望通过分析非法证据排除规则的产生历史、设置理论、适用范围和诸多限制等问题,为读者全面勾勒出该规则的全貌,并在此基础上,希望我国学术界能正确认识该规则并在未来建立适合于自己的体系。
The exclusionary rule of illegal evidence conducts as the cornerstone of US criminal procedure system and exerts great influence on the world. However, any rule has its own evolution process without exemption of the exclusionary rule of illegal evidence. China assimilates beneficial ex- perience from the world to establish its own criminal procedure system, including the experience from US. This essay delineates the historical background, philosophical principle, application scope and limitation of this rule in the hope of providing constructive information to Chinese legal academia to cre- ate Chinese own criminal procedure system.
