摘要
完善我国文化产业立法,已然成为学术界日益高亢的呼唤和积极研究的课题,然而对于文化产业立法的一些重要问题仍然存有分歧观点。通过着重讨论我国文化产业立法的现实必要性、文化产业立法调整目的、文化产业地方立法可行性和文化产业地方立法设计等认知问题,认为:(1)我国文化法律建设尚有诸多缺陷,立法滞后已不适应文化产业发展客观要求,必须加快文化产业立法,并促进整个文化法律体系建设。(2)文化产业立法目的在于管理、规范领域的社会关系,必须处理好保护公民文化权利与政府管理文化产业权力的关系,二者应当"平衡"而不可偏废。(3)在国家尚未制定有关文化产业促进法的情况下,为及时回应各地文化产业蓬勃发展亟需法律保障的现实要求,先行开展省级地方文化产业促进法规的立法是可行的。(4)地方文化产业法规应明晰法源、文化产业主体的法律地位、政府管理法律职责的界定等关键环节。
The academic community now increasingly appeals for and researches on optimizing Culture Industry Legislation in China, but scholars are debating on some important issues. The paper will be focused on the necessity, purpose of adjustment, feasibility, design and some other awareness issues and propose some relevant viewpoints. ( 1 ) Culture Industry Legislation has many drawbacks and lags behind the growth, so we should accelerate the progress and promote the development of the legal system of the culture industry, ( 2 ) the purpose of legislation is to manage and regulate social relations in the culture industry, so we should carefully dealt with the relations between the civil rights and the power of the government, both should be balanced and neither can be neglected, ( 3 ) in the case of the lack of Culture Industry Promotion Act on the centre level, it is feasible for the provincial level to go ahead of the rest to legislate in order to protect the booming development of the local culture industry, (4)the local Culture Industry regulations should make the law sources clear, affirm the legal status of the industry bodies, ensure the duty of the government and confirm some other key links.
