摘要
到目前为止我国还没有一部统一调整军用和民用航空的专门法,这将严重制约我国航空产业的发展,有必要加强我国航空立法工作。政府作为国家的行政机关,应当在航空立法中充分行使宪法和法律授予的立法职权,但目前我国政府在航空立法中还存在缺位现象,应对政府在航空立法中的角色进行明确的定位。
So far China has not formulated a uniform and special law to adjust military and civil aviation, which will seriously restrict the development of China＇s aviation industry, so it is necessary to strengthen China＇s aviation legislation. As the executive branch of state, the government is expected to exercise fully legislative authority granted by the constitution and laws in the aviation legislative process. Chinese government＇s absence from aviation legislation calls for a clear positioning of government＇s role.
