摘要
毒品犯罪是世界各国严厉打击的重点犯罪,非法持有毒品罪是毒品犯罪中一个重要的个罪,对其进行研究既有理论价值,又有现实意义。从持有毒品行为本身入手,将这种行为与其他相关类似的行为进行比较,从本质上认识持有毒品犯罪的特征、处理方法。探讨司法实践中存在争议的居间代买毒品的认定、吸食毒品行为的处理、持有假毒品的认定。
The drug crime is the world to crack down on the crime, illegal possession of drug is crime of crime, research has both theoretical and practical value. Starting from the conduct itself and with comparison between the behaviour and other related similar actions, the drug-related criminal characteristics and their methods were anaylzed. Finally, the purchase of drugs and drug consumption behavioral processing, hold off against the judicial practicewere explored.
