摘要
网络交易是一把"双刃剑",给消费者带来了许多新的、潜在的利益,但在其发展过程中也出现了种种损害消费者权益的情形,给现行消费者权益的法律保护带来了严峻挑战,也阻碍了网络交易的发展。文章在对网络交易中消费者各项权益受到侵害的情况进行法律分析,通过诉讼和非诉讼程序,力争填补法律的空白和漏洞,促使消费者权益保护进一步完善。
Network transaction is a double blade sword. It brings enormously new and potential profits to consumer. But it has gradually threatened the consumer interests and brought great challenges to the legal protection of consumer rights during its developing process. Also, it is a holdback of network transaction＇ s development. The main idea of this paper is to analyze all kinds of situations which consumer may confront in it. Through litigation and non litigation procedure, the law makers try to fill up the gaps and locp holes of the law and protect the consumer＇ s right better.
