摘要
对物的强制性侦查措施直接关涉当事人的财产权,由于我国目前对物的强制性侦查措施的采取是由侦查机关按照其内部的行政运作模式进行,缺乏强有力的外在的监督,极易导致侦查权的滥用,当事人的合法权利难以得到保障。因此,为有效地制约侦查权并保障当事人的合法权利,应在我国现有的法律框架下构建对物的强制性侦查措施的检察监督制度。
Compulsory Investigation Measures towards material evidences are closely related to the property right of the parties.At present,such measures are operated by the police offices in accordance with their own administrative regulations.As a result of lacking external supervision,it is very difficult to safeguard the lawful rights of the parties and prevent the abuse of investigation power.For this reason,it is essential to build our procuratorial supervision system for compulsory investigation measures in current legal system in order to restrict the investigation power and protect the legal rights of the parties.
