摘要
随着社会服务提供方式从"制造"向"购买"的转移,公共非营利合作关系迅速成长。对公共非营利合作关系的有效治理事关社会服务提供的最终效果,受到中国社会服务组织成长的国家依附型路径和财权上移、事权下移的政府间的服务提供体制的影响,社会服务提供中的公共非营利合作关系正处在一个体制内的自我调整阶段。合同外包尤其竞争性招投标的创新实践,反映上级政府试图通过政策干预,抑制由体制内生的基层政府与社会组织之间的管家关系;通过竞争性招投标与合同管理,拉开二者距离,引入委托代理关系,推进社会服务目标的稳固与实现。对A市公益服务招投标实践的分析表明,这种政府间的干预受制于公共非营利合作关系的制度环境,效果取决于其能在多大程度上改变政府间的相关制度与资源配置格局。
As China's social service delivery has quickly shifted from the 'make' to the 'buy' model,public-nonprofit collaboration has grown quickly.Effective governance of such collaboration seriously affects the final results of social service delivery.Due to the state-affiliated path of nonprofit development and the intergovernmental regime featured by fiscal centralization and functional devolution,public-nonprofit collaboration in social service delivery has been undergoing a process of self-adjustment.Introduction of contracting and especially competitive contracting in China's local governments reflects the purpose of the higher-level government to break the endogenous stewardship relation between lower-level governments and nonprofits through policy intervention.These reforms create an arm's length between contracting lower-level governments and nonprofits and restore a principle-agent relation between them,in order to maintain and strengthen the social service goals of such collaboration.A case study of the competitive contracting practice in municipality A tells us that such intergovernmental intervention is subject to the institutional environment of public-nonprofit collaboration.The effect depends on to what extent the high-level government can change intergovernmental institutions and resource distribution.
