摘要
教师申诉制度是教师权益保障和寻求救济的重要制度。美国高校教师申诉制度实体内容的规定较明晰,程序较完备,其特点在于:重视非正式纠纷解决方式的运用;听证制度充分体现正当程序原则;充分保障当事人的权利;注重隐私权的保护以及完善的后续救济程序等。这对完善我国高校教师申诉制度具有一定的启示。
Appeal system for teachers is the important system of the right safeguard and remedy finding of teachers. For the appeal system for teachers in American higher education institutions, the entity content is clear and the procedure is complete. The characteristics are. paying attention to the use of the informal ways to solve troubles, public hearing system's showing the proper procedure principle, guaranteeing the right of the client, paying attention to the protection of the right of privacy, having perfect subsequent remedy procedure, etc. All these have certain enlightenment on the appeal system of teachers in higher education institutions of China.
