摘要
共同正犯的定罪和量刑与犯罪人的身份关系密切。无身份者虽然不能够实行真正身份犯的整个实行行为,但可以分担该犯罪的部分实行行为,因此,无身份者可以与有身份者就某些犯罪成立真正身份犯的共同正犯。探析共同正犯与犯罪人的身份关系问题,对于正确贯彻我国刑法有效打击犯罪和尊重保障人权的理念,以及指导司法实践具有重要意义。
The condemnation and measurement of penalty of joint principal offenders are closely related to the identity of offenders. It is of momentous significance to probe into the relationship between joint principal offenders and their identity thus to carry out the idea of the criminal law and to guide the judicial practice.
