摘要
作为一种犯罪现象,世界各国都有"仇恨犯罪",近年来,我国的仇恨犯罪呈加剧态势,其根本原因是转型期社会矛盾的激化,但也包含着我国"法外复仇"的传统复仇文化的作用。要建构和谐社会,减少"仇恨犯罪"的发生,第一要务是加快推进"三公"制度的建设,同时,应当重视现代宽容的法律文化对制度建设的作用,它主要包括民众之间的宽容、政府对民众的宽容两方面,而政府在处理"仇恨犯罪"时的宽容尤为重要。
As a type of criminal phenomena,＂ Hate Crime＂ is all over the world. Recently,hate crime in China is becoming more serious than ever. The reason lies in the intensification of social contradictions in social transition. Besides ,we should not neglect the influence of ＂extrajudicial revenge＂ in the culture of revenge in Chinese tradition. In order to build a harmonious society and reduce the amount of hate crime, the foremost thing is to promote fair and reasonable institution construction. In the meantime, we should pay much attention to the function of the culture of modem tolerance to the institution. ＂Tolerance＂ includes two aspects： one is the tolerance among the people, and another is the tolerance of the government to the people, especially when handling hate crime cases.
