摘要
权利的规定性决定权利一定有其边界,公立中小学校权利亦然。依照权利理论,公立中小学校的权利主要来源于法律授权、上级教育行政部门的委托以及学校基于专业性而生的固有权利;公立中小学校权利的行使只能在其授权范围内。公立中小学校权利具有明显的限制性,其行使不具有绝对的自由。
The provision of right decides that it has its boundary, so it is with rights of public primary and secondary schools. On the one hand ,rights of public primary and secondary schools are mainly legally authorized, entrusted by the administrative departments of education at a higher level, and generated on the basis of their own specialties, so public primary and middle schools can only exercise their power in the within the scope of authority. And on the other hand, the exercise of power must be subject to certain restrictions.
