英美法系近现代判例对矿业财产权行使的发展 被引量:1

On the Development of Mining Property by Modern Precedent of Anglo-American Law

摘要 矿业权的形成源自社会经济发展对自然资源的需求与开发利用,其具有突出的财产权属性。在矿产资源财产权与土地所有权分离的过程中,英美法系国家通过判例丰富和完善了矿业财产权的行使规则,演绎了近现代民商法从物的绝对所有权保护向对物之充分利用的转变。这些承载着市场经济发展要求的财产权行使规则对我国矿业开发提供了良好的立法参考,对我国《石油天然气管道保护法》实施中的相关问题提供了解决思路。 The formation of mineral rights had been from the development of natural resources and utilization by the social and economic development, therefore, the mining right has a prominent property attributes. In the course of property rights in the mineral resources' separation from land ownership, common law countries enriched and improved the rules on the mining property through judicial precedent, deducing a change that protection for property from the absolute ownership of property to the full use in modern civil and commercial Law. These rules provided a good legislative reference for our mining development, and a solution to solve vroblems related to the imnlementation of Oil and Gas Pipelines Protection Act.
