摘要
修宪准备阶段是修宪过程中的一个必经环节和步骤,它具体包括修宪预测、规划,收集民意,听取、整合修宪意见,成立起草小组和起草修宪建议(或草案),以及修宪建议(或草案)的通过等步骤程序。在我国,修宪准备阶段的活动都是由中国共产党领导进行的,这是由我国历史和现实的客观情况所决定的。回顾建国后历次修宪的准备过程,总结党领导修宪准备阶段的一套相对固定的运作模式,同时归纳该模式运作的合理性,当对日后的修宪工作有所帮助。
Preparatory phase is necessary links and step of Constitutional amendment.It includs forecasting,planning,collecting public opinions,listening to and integrating views,establishing drafting group and drafting constitutional amendment proposals and other steps of Constitutional amendment process.In China,preparatory phase of amending the Constitution is under the leadership of the Party,which is decided by our history and reality of Chinese conditions.Through reviewing all previous preparatory phase of amending the Constitution,the author summarizes the model of preparatory phase of amending the Constitution under the leadership of the Party,makes a preliminary study about the rationality of this mode with a hope of being helpful to the future Constitutional amendments.
