从一定意义上说,市场经济是一种人才竞争经济,竞业现象因之而出现。分析竞业现象产生的深层原因是我们了解和合理规制竞业禁止的基础和前提;正确把握竞业禁止的原则是合理规制竞业禁止的关键环节;释解竞业禁止的有关法律规定和缺陷为合理规制竞业禁止指明了方向。通过合理限制竞业禁止、构建诚信机制和强化ADR纠纷解决机制,促进劳动关系和谐发展。
In some sense,market economy is a kind of skilled people-contended economy,which results in competition phenomenon.Analyzing why the competition emerges is the basis and premise of properly regulating competition constrictions.Defining the principles of the competition constrictions is key step of properly regulating competition constrictions.Knowing the reluctant law provisions and drawbacks of competition constrictions can define a due direction to the proper regulation of competition constrictions.To limit competition restrictions,construct honesty system and emphasize function of the ADR can promote the harmonious development of employment relations.
