摘要
水权交易可以提高缺水地区水资源的配置效率和利用效率,并已逐渐成为该地区新增用水的主要方式。在交易过程中交易双方的利益常常会优先考虑,但交易主体之外的第三方由于缺乏契约保护,甚至未能进入交易博弈的过程,只能被动接受交易的影响,第三方受害者常常难以得到补偿。第三方效应问题的存在既影响水权交易市场的有效性,又影响到水权交易市场的公平性,对水权市场提出了严峻挑战。
Water property rights transaction is the effective way to improve the efficiency of water allocation and using,which has become the main way of new increasing water using. But in the transaction process, the interests of trade agent is often given priority, the third parties for the absence of contractual protection, are even could not access to water rights trading game process,and only infulenced by transaction passively,and their interests often could not be compensated.The being of third-party effects has influenced the water rights trading efficiency and equity, brought great challenges to water rights market.
