摘要
寒地黑土知识产权的研究,关乎寒地黑土经济与品牌、食品安全与寒地黑土资源保护、寒地黑土产品市场开发、寒地黑土民间文学艺术的繁荣。寒地黑土地理标志权是在历史中逐渐形成的共享性的集体性权利,具有产地产品品质保证功能。面对侵权,公权机关的保驾护航和行业协会的责任定位是关键。寒地黑土民间文学艺术作品的著作权及其保护面临研究乏力和法律规定空白的境遇,亟需提炼出具有普遍意义的思想成果。
The research of intellectual property rights of the Cold Region and Black Glebe concerns the black glebe economy, its brands, food safety, the conservation of the Cold Region and Black Glebe resources, market development of products in the Cold Region and Black Glebe, the prosperity of fork literature and arts of the Cold Region and the shared community Black Glebe. The right Of Geographical Indications of the Cold Region and Black Glebe is right which is formed gradually in the history and has the function to guarantee the product quality in its habitat. The guarantee of the administrative civil rights institution and the Responsibility Orientation of Business Associations are the key to fight the copyright infringement. The copyright and of fork literature and arts of the Cold Region and Black Glebe and its protection meet with Inefficient research and the situation in which there is no corresponding law and rule. It is urgent to distill universal achievements in thoughts.
