摘要
中国特色宪政建设,仅有纯粹的法学理论和宪法规范是不够的,还应从公民宪政需求的视角予以审视和批判。因此,梳理需求理论和法律需求理论,较为准确地解读公民宪政需求及其基本内涵,即宪法规范需求、宪政秩序需求和基本权利需求,以期深入探讨完善公民权利条款、有效推进宪政建设和保障公民基本权利,具有重要的理论与现实意义。
The constitutionalism construction with Chinese characteristics is not sufficient merely with purely legal theory and Constitutional standardization,however it should be examined and criticized from the perspective of civics＇ constitutionalism demand.It is of importantly theoretical and actual significance to comb through demand theory and legal demand theory,accurately interpret civics＇ constitutionalism demand and its basic contents,i.e.Constitutional standardization demand,constitutionalism order demand and basic rights demand,profoundly discuss the stipulations of improving civics＇ right,and effectively promote constitutionalism construction and protect civics＇ basic right.
