摘要
基本权利与宪法发展的关系是宪法学研究不能回避的重要问题,基本权利是宪法发展的基点,宪法的发展是对基本权利需求的反映,宪法的发展状况影响着基本权利的发展水平。随着我国公民社会的孕育、法治社会的推进以及人权理念的发展等情势的出现,基本权利与宪法发展具备有利时机。树立人权理念,加强人权的系统性立法和有效性保障是推进我国人权实现和宪法纵深发展的必然选择。
Constitutional research can not be regardless of relationship between fundamental rights and the con- stitution development. Fundamental rights are the basic point of the Constitution, and the Constitutional development is what the basic rights demand for. Constitutional development affects the level of development of fundamental rights. With the birth of civil society in China and the promotion of the rule of law, the development of fundamental rights and constitution gets a favorable opportunity. Cultivating the concept of human rights that continues to keep up with international human rights concept and strengthening human rights legislation which is effective and systemic is to make China~ human rights into practice and to stimulate in - depth development of the Constitution.
