摘要
当前,中国立法上对于农村土地承包经营权流转的规范欠完善,已成为制约农村经济发展的瓶颈。完善中国农村土地承包经营权流转制度对促进中国农业结构调整和农村资源的优化配置,促进社会主义农村市场经济的发展具有重要意义。针对土地承包经营权流转中存在的相关法律问题进行分析与研究,力图从法律层面,提出完善农村土地承包经营权流转法律制度的对策,以此促进整个农村土地承包经营权流转制度的完善。
Currently, China＇ s legislation was very poor for the moving of managerial authority of the land contracting, and has become the bottleneck of restricting the development of rural economy.Perfecting the contracted management of rural land circulation system is very im- prortant to promote socialist rural market economic development, rural resources disposition and socialist rural development of market economy.To promote the managerial authority of land contracting,the paper tries to research and analysis from circulation relevant legal issues, and put forward the legal aspects.
