摘要
改革开放以来,中国在法制建设、法治国家与政治发展方面取得了重大的进展。国内学者从宪政、法治与依法治国、法治政府与法治国家及法治与政治文明四个方面进行了有益的探索。国外学者主要从中国法制、法治国家和政治发展等角度进行了研究。国内研究认为,中国在法制建设、法治国家与政治发展方面取得了重大的进展,但还不够完善,必须通过制度化、规则化和文明化,通过政治文化祛魅推动法治进步与政治发展。国外研究认为,中国在法制建设、法治国家与政治发展方面取得重大进展的原因在于引入了西方式的自由平等和法治理念,在培育中国公民社会上下了工夫。然而,他们对中国法治建设和民主化发展方向的解读是不科学、不正确的。了解国内外研究动态,对于我们更好地推进中国的法制建设、法治国家与政治发展具有重要的理论和实践意义。
Since the reform and opening up,great significant progress has been made in China＇s legal system,state of rule of law and political development.Constitutionalism,rule of law and governing the country in accordance with law,Democracy and state of rule of law,rule of law and political civilization are four aspects which Chinese scholars have explored.In addition,foreign scholars believe that China＇s legal system,rule-of-law country and political development are still not perfect,but compared to the past,tremendous progress has been made on the rule of law and political development,they not only believe that the emergence of civil society in China,as well as the raised status of National People＇s Congress improvements promoted China＇s political development,but also believes that China has made significant progress in improving the rule of law and the democracy and so on.
