摘要
随着我国经济社会的发展,《工伤保险条例》在实施的近7年时间里出现了一些新情况、新问题。特别是工伤认定48小时的规定在实践中暴露出的弊端较多,与我国构建和谐稳定的劳动关系的宗旨不相适应。因此,我国现阶段有必要借鉴较为成熟国家的"工伤认定"制度标准,以完善我国工伤认定条件,使我国的工伤保险制度更具有"人性"。
With the economic and social development,the Regulation on Work-Related Injury Insurances in the implementation of nearly 7 years appear some new situations and new problems,Especially the work-related Injury Identification of 48 hours in practice presents more drawbacks not adapted to the aim of constructing the harmonious and steady work relationship in our country.Therefore,it is necessary to learn from the more mature countries of the "Work-related Injury" system standard to improve conditions of work-related injuries identified in our country and enable work-related injury insurance system in China more "humanity".
