摘要
城镇化进程是伴随着大量近郊农村的拆迁与集体土地的征用进行的,而拆迁进程中存在的混乱与无序主要缘于我国房屋拆迁法律制度的缺陷与地方政府的错位。为此,应修改《土地管理法》,使集体土地产权真正归农村集体所有;应直接制定《征地拆迁法》,建立公平合理的拆迁补偿制度和公开正当的征地拆迁程序,并予以政府合理的角色定位和相应的法律责任,保障被征迁人的合法权益。
The urbanization is accompanied by the large demolition of suburban country and the expropriation of collective land,but the chaos and disorder existing in the process of demolition are mainly due to the legal defects and the local government dislocation.Therefore,the Law of Land Administration of People＇s Republic of China should be modified to make collective land property rights really owned by rural collective.The law of land expropriation and housing removal should be directly enacted to establish the fair and reasonable compensation system and open procedures,make the government a reasonable role and corresponding legal responsibility,and safeguard the legal rights of the expropriated.
